Rental Terms and Conditions
§1 General provisions
- The person renting the equipment is obliged to read the regulations and the price list. Deciding to rent the equipment, he/she enters into a civil law contract with the company Graal Artur Wnuk, ul. Słowackiego 37C, 27-600 Sandomierz, NIP: 8641149964.
- Rental of equipment is possible only by adults, sober, not under the influence of alcohol or intoxicants. In case of doubt, the rental employee has the right to refuse the service.
- The equipment (bicycles and electric boat) is owned by Graal Artur Wnuk.
- Rented equipment is not insured. The hirer is fully liable for damages unless it enters into a separate insurance contract.
§2 Bicycle rental
- To rent a bicycle you must: present an ID card and a second document with a photo, be of legal age, sign a contract, accept the terms and conditions, pay a deposit and rental fee.
- The refundable deposit for one bicycle is 500 zloty.
- The use of bicycles by minors is possible only under the supervision of an adult who takes full responsibility for them.
- The bicycle must be returned in a technical condition not deteriorated from the time of rental.
- The renter is personally responsible for the bicycle from the moment of rental until its return.
- It is forbidden to transfer the bicycle to a third party – you risk losing your deposit.
- The renter declares that he knows the rules of operation and undertakes to use the bicycle safely.
§3 Rental of an electric boat
- No license is required to rent an electric boat.
- The refundable deposit for the electric boat is PLN 2,000.
- Rental is possible only for sober adults.
- The boat must be returned in an undamaged and technically sound condition.
- Self-repair, modification and transfer of boats to third parties without permission of the rental company is prohibited.
- Transport of the boat possible only with the approval of the rental company – full responsibility for transportation rests with the customer.
§4 Liability and damages
- The renter is liable for damages: intentional and unintentional, resulting from warfare, riots, etc., theft of equipment or its parts, use contrary to its purpose, participation in sports competitions or extreme expeditions, transportation without the consent of the rental company.
- In case of damage to the equipment: charges for repairs or parts are taken from the deposit, if the cost exceeds the deposit – the renter covers the excess, the parts are replaced with new ones, in case of damage beyond repair – the customer covers the cost of new equipment.
- A detailed damage assessment is provided within 7 days based on market value.
§5 Return of equipment
- The equipment must be returned by the date specified in the contract, in working order.
- In case of delay – you must inform the rental company at least 1h before the end of the rental. Fee for each commenced hour of delay: PLN 100.
- Failure to return the equipment after 12h from the end of the lease will result in a report to the police as misappropriation of property.
§6 Reservations and waivers
- Reservations can be made by phone or through the sandobike.co.uk website.
- The reservation becomes effective after payment is made to the rental company’s account.
- The rental company reserves the right to change the bicycle or boat to another equipment of the same class.
- Cancellation possible no later than 3 days before the rental date – refund within 14 days.
- Cancellation later than 3 days before the date – no refund of the fee. Failure to pick up the equipment is considered a cancellation.
- After the conclusion of the contract, withdrawal is possible only through the fault of the rental company or due to force majeure. Adverse weather, injury, state of intoxication – are not grounds for withdrawal.
§7 Complaints
- The renter has the right to file a complaint in case of concerns about the quality of the equipment or the manner in which the rental service was provided.
- Complaints should be reported immediately, no later than 3 days after the end of the rental, in writing to the address: Graal Artur Wnuk, ul. Słowackiego 37C, 27-600 Sandomierz or by email to: support@sandobike.pl.
- The complaint should include: the contact information of the renter, the date and number of the rental, a description of the irregularity and the complaint request.
- The rental company will consider the complaint within 14 days from the date of receipt. The customer will be informed of the result of the consideration in writing or by e-mail.
- If the complaint is accepted, the rental company may offer: a refund of part or all of the fee, the resumption of the service at the rental company’s expense, another form of compensation agreed with the customer.
- Complaints submitted after the deadline or that do not meet formal requirements may be left unprocessed.
- Use of the complaint procedure does not exclude the customer’s right to pursue claims through the courts.
§8 Final provisions
- The rental company is not responsible for latent defects in the equipment and for the consequences of the customer’s failure to comply with the regulations.
- Provision of personal data is voluntary, but necessary to carry out the rental. The data is processed in accordance with RODO by Graal Artur Wnuk.
- The data is kept for the period of performance of the contract and until the statute of limitations for possible claims.
- In matters not covered by these regulations, the provisions of the Civil Code shall apply.
- Disputes shall be resolved by the court having jurisdiction over the seat of the rental company.
- In case of non-compliance with the rules – the employee of the rental company has the right to refuse to rent equipment.
